These Terms of Service ("Terms") govern access to and use of the website at leveluploanprocessing.com and any related services (collectively, the "Services") provided by Level Up Loan Processing, LLC ("Level Up," "we," "us," or "our"). Level Up is a mortgage loan processing company licensed and operating from Houston, Texas, serving licensed mortgage brokers and loan officers. We are not a lender, mortgage broker, or financial institution. We do not originate loans, extend credit, lock rates, set terms, or make lending decisions. Our role is to assist licensed mortgage professionals with the operational steps of loan processing under their direction.

2. Eligibility

The Services are intended for licensed mortgage brokers, licensed loan officers, branch managers, and other professionals authorized to originate or assist with residential mortgage transactions. By submitting an inquiry or engaging us, you represent that you have the authority to do so on behalf of yourself or the entity you represent.

A formal engagement between you and Level Up begins only after we provide and you accept a written scope of work or processing agreement.

6. Processing Services

When Level Up provides loan processing services, the relationship between Level Up and the broker, lender, borrower, and any other parties is defined by the applicable processing or service agreement. In the absence of such a written agreement, no processing relationship exists. We perform processing services as a contractor to the licensed broker or loan officer responsible for the file.

7. Confidentiality and Data Protection

Level Up will treat non-public personal information (NPI) we receive in the course of processing a loan in accordance with the Gramm-Leach-Bliley Act (GLBA), applicable state laws, and our internal data protection standards. Our handling of personal information is further described in our Privacy Policy, which is incorporated into these Terms by reference.

13. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising under or related to these Terms or your use of the Services will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. The "Effective" date at the top reflects the latest revision. Continued use of the site or Services after a change indicates acceptance of the revised Terms.
